Terms & Conditions, Cancellation and Refund Policy

These Terms & Conditions apply to purchases, bookings and payments made to Dennis Tan Creative (“we”, “us” or “our”) through our website, online payment facilities, invoices or other authorised payment methods.
By purchasing a product, making a payment or booking our services, you agree to these Terms & Conditions.
1. Our Services
Dennis Tan Creative provides photography services and may offer products including:
- Photography sessions
- Wedding and event photography
- Digital photographs and galleries
- Prints and photographic products
- Albums
- Gift certificates
- Other photography-related products and services
Specific photography bookings may also be subject to a separate quotation, booking agreement or photography contract.
Where a specific signed photography agreement conflicts with these general Terms & Conditions, the specific photography agreement will apply to that booking, subject to applicable law.
2. Pricing
Unless stated otherwise:
- Prices are displayed in Australian dollars (AUD)
- GST is included where applicable
- Prices and product availability may change without notice before a booking or purchase is confirmed
The price shown on your quotation, invoice, checkout page or booking agreement at the time of purchase will apply to that transaction.
3. Payments
Payments may be accepted through Square or another approved payment provider.
Depending on the service, payment may be required:
- In full at the time of purchase
- By a booking fee or retainer followed by one or more instalments
- According to the payment schedule shown on your invoice or photography agreement
A photography date is not considered secured until any required booking agreement and initial payment have been received.
4. Payment Security
Card payments are processed by third-party payment providers such as Square.
Dennis Tan Creative does not intentionally store complete credit or debit card details on our website.
Your transaction may also be subject to the payment provider’s terms and privacy policies.
5. Photography Booking Cancellations
Cancellation conditions for photography bookings are primarily governed by the photography agreement provided for that booking.
If you cancel a booking, any amount retained as a cancellation fee will be subject to the terms of your agreement, applicable law and the reasonable costs or losses associated with the cancelled booking.
Where possible, we encourage clients to contact us as early as possible if circumstances change.
6. Rescheduling
Requests to change the date or time of a photography booking are subject to availability.
Where we agree to a reschedule, existing payments may be transferred to the new date in accordance with the applicable photography agreement.
Additional charges may apply if the rescheduled booking results in additional travel, services, staffing or other costs. Any such charges will be communicated before the change is confirmed.
7. Weather and Circumstances Outside Our Control
Outdoor photography may be affected by weather.
Where appropriate, we may discuss alternative locations, timing or rescheduling options with the client.
If an event cannot proceed because of circumstances outside either party’s reasonable control, the options available will depend on the circumstances and the applicable photography agreement.
8. Refund Policy
We assess refund requests individually according to:
- The type of product or service purchased
- Whether work has already been performed
- Costs already incurred
- The terms of the applicable booking agreement
- Your rights under Australian law
We do not provide refunds simply because a customer changes their mind after photography services have been properly performed or digital products have been supplied, unless we have agreed otherwise.
This does not affect any rights or remedies you may have under the Australian Consumer Law.
9. Problems With Services
If you believe there is a problem with a photography service or other service we have provided, please contact us as soon as reasonably possible and provide details of the issue.
We will assess the matter and, where appropriate, provide a remedy in accordance with applicable Australian Consumer Law.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
10. Prints, Albums and Physical Products
Please inspect physical products after delivery and contact us promptly if an item arrives damaged, defective or incorrect.
We may request photographs or other information so we can assess the issue.
Where a product is faulty or does not meet applicable consumer guarantees, an appropriate remedy will be provided in accordance with Australian Consumer Law.
Custom-made photographic products are generally not returnable solely because of a change of mind unless otherwise agreed.
11. Digital Products and Photographs
Digital photographs and downloadable products cannot ordinarily be returned once delivered or downloaded.
If you experience a technical problem accessing or downloading your photographs, please contact us so we can assist.
Your statutory consumer rights remain unaffected.
12. Image Editing and Appearance
Photography involves artistic judgement.
Our photographs are supplied in our professional editing style, and differences in artistic preference alone do not necessarily constitute a fault or defect.
Any specific retouching or editing requirements should be discussed before booking or ordered separately where available.
13. Delivery
Estimated delivery timeframes for photographs, galleries, prints and albums may be provided at the time of booking or purchase.
Delivery estimates are not guarantees unless specifically stated otherwise.
We will take reasonable steps to complete and deliver products and services within the agreed or reasonably expected timeframe.
14. Gift Certificates
Gift certificates purchased from Dennis Tan Creative:
- Are valid for at least three years from the date of purchase unless a longer validity period is stated
- Must be used before the applicable expiry date
- May be applied toward eligible Dennis Tan Creative services or products, subject to the conditions stated on the certificate
- Are not redeemable for cash except where required by law
- Cannot be used to purchase another gift certificate unless expressly permitted
- May require the customer to pay any difference where the selected service exceeds the certificate value
Gift certificates should be treated like cash. Please contact us if a certificate is lost or cannot be located and we will determine whether it can be reissued based on our available records.
15. Subscriptions and Recurring Payments
Unless expressly stated at the time of purchase, Dennis Tan Creative does not automatically enrol customers into recurring subscriptions or recurring payments.
A payment made through our website or Square is a one-off payment unless you have specifically authorised a recurring payment arrangement.
Where a subscription or recurring payment service is offered in the future, its price, billing frequency, cancellation process and applicable terms will be clearly disclosed before the customer agrees to subscribe.
16. Client Responsibilities
Customers are responsible for ensuring that:
- Information supplied when making a booking or purchase is accurate
- Contact details remain current
- Payments are made by the applicable due dates
- Necessary permissions or approvals for photography locations are obtained where the booking agreement places that responsibility on the client
- We are advised of relevant changes that may affect the booking
17. Intellectual Property
Unless otherwise agreed in writing, copyright in photographs created by Dennis Tan Creative remains with the photographer.
Clients receive the personal-use or other licence specified in their photography agreement or accompanying licence terms.
Photographs may not be sold, commercially licensed or materially altered for commercial purposes without permission unless the applicable agreement expressly allows it.
18. Privacy
Personal information collected through purchases and bookings is handled in accordance with our Consumer Data Privacy Policy.
19. Changes to These Terms
We may update these Terms & Conditions from time to time.
Changes will apply to future purchases and bookings from the date the updated terms are published. Existing bookings remain subject to the terms and agreements applicable when they were entered into, except where a change is required by law or agreed between the parties.
20. Governing Law
These Terms & Conditions are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.
